2005 daylight savings time
debacle:
The USDOT’s ruling on time zones moved Starke and
Pulaski Counties in northwest Indiana to the Central Time Zone, and
Knox, Daviess, Martin, Pike, Dubois And Perry Counties in southwest
Indiana to the Central Time Zone. Those counties that petitioned for
Central Time, but were denied were St. Joseph, Marshall, Fulton,
Benton, White, Carroll, Cass, Vermillion, Sullivan and Lawrence
Counties. An interesting observation
is that with the exception of Vermillion, Sullivan and Lawrence
Counties, the rest of the counties that were denied Central Time (i.e.
7 counties) were from the northwest corridor of Indiana.
Two other points to be made is that :
1) Pulaski County was initially denied
their request to move to the Central Time Zone, then failed to
resubmit any additional information, but were granted their initial
request for the Central Time Zone.
2) St Joseph County worked diligently to reinforce their position for
Central time, which was initially granted, but then on the final
ruling (at the request of Governor Daniels) was denied.
It should be noted that Governor Daniels violated Ind. Code 1-1-8.1-3,
which states
Sec. 3. The state supports the county executive of any county that
seeks to change the time zone in which the county is located under the
procedures established by federal law.
Plain and simple, Governor Daniels broke the law.
Adding insult to injury, the Indianapolis Star proclaims the clock has
expired for DST replays in a November 28,2005 article. The last
statement in the article “Any compromise of a clear-cut identity for
the state in the matter of time dishonors the vote to spring forward.”
Lets retrace how much dishonor their was in that vote. The original
Daylight Savings Time Bill House Bill #1034 was granted a hearing by
the House of Representatives Commerce, Economic Development and Small
Business Committee composed of 12 members including Steve Heim
(District 17) and Jackie Walorski (District 21). Steve Heim voted for
HB #1034 (against the wishes of his constituents), while Jackie
Walorski was absent from the vote. Representative Walorski’s absence
was presumably due to a scheduling conflict, but I am told she was
instructed to stay in another room out of site. As it be, if either
Rep. Walorski or Rep. Heim had represented their constituents, and
voted no, the bill would have died, and could not have been introduced
later on (as it was in Senate Bill 127). The original House Bill 1034
was never given a vote on the House floor, due to the wisdom of some
politicians that knew what a can of worms they were dealing with.
But that didn’t satisfy our governor, who convinced Senator Riegsecker,
R- Goshen, to strip his original bill, and The House Committee on
Public Policy & Veterans Affairs reworded it to insert Daylight
Savings Time. Senate Bill 127 passed the committee by an 8 to 4 vote.
Representative Marlin Stutzman, R-Howe (LaGrange County: Pro-Central
time) voted for the bill, and against the wishes of his constituents.
The first full House of Representatives vote failed 49 to 50, but
since there was not a simple majority, a second vote passed the bill
51 to 47. Three representatives flip-flopped on their votes (i.e.
Representative Eric Gutwein (R-Rensselaer), Representative Don Lehn
(R-Brookston), and Representative Richard McClain (R-Logansport). All
three Republican Representatives serve parts of White County
Senate Bill 127 then assigned to a Conference Committtee consisting of
two Senators (Senator Riegsecker, R-Goshen, and Senator Sipes, D-New
Albany (Already observes Eastern Daylight Time in violation of state
law before it was passed) and two Representatives (Representative Torr,
R-Carmel,(pro-Daylight Savings Time), and originally Representative
Crooks, D-Washington (who refused to sign off and bill and was
replaced by Representative Borror, R-Fort Wayne ( pro-Daylight Savings
Time).
Senate Bill 127 was then sent to the Senate Rules Committee, where a
hearing of people and business representatives produced an equal
number for and against. But the Senate Rules Committee narrowly passed
the bill by a vote of 6 to 5. Senator Zakas (R-Granger) and Senator
Riegsecker (R-Goshen) voted in favor of the bill. Senator Allen Paul
(R-Richmond) voted yes in committee in order to let the bill go to the
full Senate, but voted no against the bills final passage ( some
consolation, or simply a political bail out to make the governor happy
it went out of committee). One note of interest was when Senator
Earline Rogers (D-Gary) asked Secretary of Commerce Pat Miller if she
could specifically attribute any lost of jobs in Indiana not observing
daylight savings time, her response was “ No, but…..” I think that
pretty well sealed the deal for me. No data to substantiate your
claim, no buts. And the Senate Rules Committee Hearing, their were an
equal number of people and businesses for and against the bill, but
still the Senate committee passed the bill on . Senator Rogers
(D-Gary) voted no on the bill in committee, but voted yes in the full
Senate vote. What I don’t like about Senators and Representatives in
the Central Time Zone voting in favor of such a bill, is that they
already observe Daylight Savings Time, so it has no effect on them or
their constituents.

would require all of Indiana to observe daylight-saving time. Voting
yes were 20 Republicans and eight Democrats. Voting no were 13

Then comes the real fiasco in the House of Representatives on the
final vote. The initial vote taken the night of April 28 came in at 48
votes for, 49 votes against. A request was made to close the vote, but
the Speaker of the House Brian Bosma (R-Indianapolis) would not. There
was a lot of manipulation of votes occurring, and just when two
representatives (Rep. John Ulmer,R-Goshen, and Rep. Woodruff, R-Vincennes)finally
changed their votes, Rep. Bosma immediately locked out the vote so no
one else could change their minds, and the bill passed 51 to 46.
During the time the vote was left open, it should be noted that Rep.
Heim (R-District 17) voted for a reconsideration to keep the vote
open, and quite a few representative were escorted down to the
governor’s office to try and change their vote against the wishes of
their constituents. It should also be noted that Rep. Woodruff
(R-Vincennes), who cast the deciding vote against the strong
opposition of his constituents, found his wife suddenly had a
unadvertised job with the Indiana Department of Transportation (how do
we say payoff).

Steve Heim Two days Prior to committee hearing told local media his
district was overwhelmingly opposed to EDT. Therefore he was a
NO vote. following the hearing explained that he had heard compelling
testimony in favor of DST. He Claimed the bill needed to be presented
before the entire House for a "Straight up or Down vote." What a joke!
With Walorski missing, the bill sailed out of committee 6 to 5. A no
vote by Heim & the bill is killed.
